Welcome to Artwear Collective, a third party print on demand service provider committed to curate unique and edgy designs for individuals seeking self-expression and individuality. These Terms and Conditions ("Terms") govern your use of our website, mobile applications, and any other Artwear Collective products or services (collectively, the "Services").

Please carefully read these Terms before using the Services. By using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Services. These Terms may be updated from time to time without prior notice. Your continued use of the Services after such updates will constitute your acceptance of the updated Terms.

1. Acceptance of Terms

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Services.

2. Eligibility

You must be at least 18 years of age to use the Services. By using the Services, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

3. Account Registration

• Account Registration is not required. Users can send an email to Artwear Collective at: contact@artwearcollective.co.uk with the images they want to have printed on their items.

• Upon receiving the email, Artwear Collective will process the order and notify the user once the order is ready for delivery.

4. User Conduct

You agree to use the Services in accordance with all applicable laws and regulations. You agree not to use the Services for any illegal or unauthorized purpose. You are responsible for all content that you submit to the Services. You agree not to submit any content that is:

• Illegal, harmful, threatening, abusive, harassing, defamatory, libelous, invasive of another's privacy, hateful, racially, ethnically, or otherwise objectionable

• Fraudulent, deceptive, or misleading

• Infringing on the intellectual property rights of others

• Harmful to minors

• Otherwise objectionable to Artwear Collective in its sole discretion

• You are responsible for ensuring that you have the necessary rights and/or permissions to use any images, branding, names, or other materials that you submit to Artwear Collective for printing on demand.

• You agree to indemnify and hold Artwear Collective harmless from and against any and all claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the Services, your violation of these Terms, or your violation of any rights of any third party.

Artwear Collective reserves the right to remove any content that violates these Terms.

5. Copyright

Artwear Collective owns or licenses all intellectual property rights to the Services, including but not limited to the copyrights in the content, artwork, and other materials displayed on the Services. You agree not to copy, reproduce, distribute, modify, create derivative works of, publicly display, perform, or in any way exploit any of the content, artwork, or other materials displayed on the Services without the express written consent of Artwear Collective.

6. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" AND ARTWEAR COLLECTIVE EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. ARTWEAR COLLECTIVE DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, NOR DOES ARTWEAR COLLECTIVE WARRANT THAT THE SERVICES ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

6.1 Order Approval and Processing

• Upon receiving your email with the image you want to have printed on your chosen item, Artwear Collective will create a mockup of the design for your approval.

• Once you have approved the mockup, Artwear Collective will proceed with printing your order.

• Cancellations are not possible once your order has been approved and printing has started. This is because our products are handmade to order and our team starts working on your order as soon as your approval email arrives.

7. Limitation of Liability

IN NO EVENT SHALL ARTWEAR COLLECTIVE BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE USE OF THE SERVICES, EVEN IF ARTWEAR COLLECTIVE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE ENTIRE LIABILITY OF ARTWEAR COLLECTIVE UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT ACTUALLY PAID BY YOU TO ARTWEAR COLLECTIVE FOR THE SERVICES.

8. Indemnification

You agree to indemnify and hold Artwear Collective harmless from and against any and all claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the Services, your violation of these Terms, or your violation of any rights of any third party.

9. Termination

Artwear Collective may terminate your access to the Services at any time for any reason, including but not limited to your violation of these Terms. Upon termination, you will immediately cease using the Services and destroy all copies of the Services.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of laws principles.

11. Entire Agreement

These Terms constitute the entire agreement between you and Artwear Collective regarding the Services and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.

12. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck from these Terms and the remaining provisions shall remain in full force and effect.

13. Waiver

Failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
